PURPOSE
Under the general direction of the City Attorney, is responsible for representing the City on all matters heard in, and appealed from, the Henderson Municipal Court; reviews complaints for prosecutorial merit; drafts motions and pleadings; drafts City ordinances; and performs related duties as assigned.
ESSENTIAL FUNCTIONS
Responsible for all tasks associated with case management and execution of activities for trials and arraignments and prosecution of misdemeanors including review of files and complaints, preparation of information for court, negotiation with defense attorneys, and the preparation and presentation of jury trials
Performs case preparation activities including the identification, interviewing and preparation of witnesses, the review of related 911 call tapes and PD videos, coordination with victims and victim advocates, and file review and management
Prosecutes traffic and parking violations from the initial appearance through higher court appeals
Performs legal research and interpretation as appropriate; prepares motions and briefs; prepares reports and opinions, and recommends policies and procedures related to cases handled by Municipal Court
Drafts City ordinances and resolutions
Attends court sessions and performs associated duties for bail hearings and/or arraignments which may be heard on the weekend and/or legal holidays
MINIMUM QUALIFICATIONS
- Juris Doctorate from an American Bar Association (ABA) accredited law school
- Must be licensed to practice law in the State of Nevada and be in good standing with all State Bars to which he/she is licensed to practice law
- Must pass a nationwide fingerprint-based record check, and a wants/warrants check
- Must obtain and maintain Security Awareness and National Crime Information Center (NCIC)/Nevada Criminal Justice Information System (NCJIS) certification upon hire/transfer and recertify as needed. Must maintain certifications in NCIC/NCJIS as a condition of continued employment
- Desirable: Trial and courtroom experience
- Desirable: Municipal government experience
KNOWLEDGE, SKILLS, AND ABILITIES
- Knowledge of criminal law and procedures, including but not limited to constitutional law and procedure, rules of evidence, criminal procedure and the appellate process; methods and techniques used for effective and efficient legal research, trial preparation, trial procedure, and trial presentation; applicable federal, state, and local laws, ordinances, rules, codes, and regulations; principles and practices of project management; City of Henderson organizational structure, including the City’s overall operation, mission, and goals; public relations practices and techniques; computer software related to conducting legal research; correct English usage, including spelling, grammar, and punctuation; and record keeping practices and procedures
- Ability to interpret and make decisions in accordance with laws, regulations, and policies; present statements of law, fact, and argument clearly and logically both in writing and verbally; draft clear and concise legal positions, papers, briefs, motions, and responses; conduct research on legal problems; demonstrate confidence and competency when making decisions; present well in the courtroom; respectfully interact with the court and judges and maintain effective working relationships with those contacted in the course of work; take initiative and complete assigned tasks in a timely manner; work independently with minimal supervision; and use sound judgment in handling sensitive issues; be a team player and fill in for other attorneys; be open to suggestions and/or criticism to improve trial skills, case management, and professional relationships with colleagues; be thorough and take pride in the quality of work produced

Work requires travel to attend meetings and to coordinate City functions.
May be required to work an alternative or flexible work schedule, outside of normal business hours, which may include evenings, weekends, holidays, and/or extended hours.
Pursuant to the Henderson City Charter, this is an unclassified position not covered by the City of Henderson Civil Service Rules. This means that the incumbent’s employment is at-will, and may be terminated for any or no reason, with or without cause or notice, at any time by the incumbent or the City.
