As Senior Litigation Counsel, you assist the Company with litigation and regulatory matters involving its life, individual disability income and commercial and government insurance operations. Litigation attorneys provide advice and counsel across the Guardian enterprise on a variety of topics including Product Development and Marketing, Underwriting, Claims, and employment issues. The primary challenge for this position lies in the diversity of competencies required to respond to the litigation needs of every profit center and subsidiary in the Company. Internally, this position interacts with all departments and at all management levels.
You will serve on ad hoc committees and project teams within the Company to address inter-departmental needs and solve for recurring issues that create exposure for the enterprise. Externally, you will interact with attorneys representing the Company, opposing counsel, judges, state insurance department personnel, Guardian Field Representatives and brokers, peers in the insurance industry, trade associations, policy owners, and vendors.

You Will

  • Report to the Vice President & Chief Litigation Counsel who, in turn, reports to the Executive Vice President and General Counsel.
  • Provide Strategic and effective case management and budget discipline.
  • Provide advice and counsel to all departments on a variety of issues including breach of contract, bad faith, suitability and sales practices, class actions, ERISA, investment and real estate, reinsurance and bankruptcy.
  • Manage and direct outside counsel on a national portfolio of financial services litigation.
  • Develop and deliver proactive trainings on recurring issues.
  • Collaborate across business lines and with colleagues in the Law and Compliance Departments.
  • Lead operational excellence projects to streamline processes.
  • Manage multiple projects and deliverables simultaneously.
  • Adapt to changing business priorities and environments.
You Have
  • Minimum of 7 years of litigation experience.
  • Law degree from an accredited institution and demonstrable academic success required.
  • Insurance or financial services experience, including interaction with executives, adversaries and regulatory personnel is strongly preferred.
  • Respect for diversity and ideas of others.
  • Proactive communication skills and willingness to collaborate in a fast-paced environment.
  • Active listening skills with a demonstrated history of growth, innovation, problem solving and excellent client service.

Location and Travel
WFH flexibility within driving proximity to clients primarily in New York, NY, Bethlehem, NY and Pittsfield, MA. There's need for occasional travel to Guardian' regional offices and / or to attend certain litigation functions (i.e., mediations, depositions, court hearings).
